This is a translation of our terms and conditions, which are written in Spanish. If there is any difference between them, the Spanish version prevails.

Introduction

The following terms and conditions (the “Terms and Conditions”) govern the relationship between: (i) the user (the “User”) interested in ordering the Web Hosting, Virtual Server (VPS), Game Server or Dedicated Server services (the “Services”), and (ii) ARMYRED HOST, as a provider of hosting for different types of digital services.

The User agrees that placing an order through the Website implies agreement with and acceptance of these Terms and Conditions.

1. Acceptance of the terms

If the User does not agree with the Terms and Conditions, they must refrain from ordering the Services offered on the Website. Otherwise, the User will be deemed to have fully accepted the conditions set out in these Terms and Conditions and expressly undertakes to comply with them.

2. Ordering services

Required information

To order the Services, the User must identify themselves by providing the following personal information:

  • First and last name
  • ID number (national ID card, DNI or passport) or CUIT tax number
  • Email address
  • Full address

In some cases, if the User requires an invoice issued through AFIP (Argentina’s tax agency), it can be requested.

Accuracy of information

The User is solely responsible for the accuracy and authenticity of the information they provide. ARMYRED HOST may request supporting documents and/or additional information to verify the accuracy of the information provided, and may temporarily or permanently suspend the User when the information cannot be confirmed.

Transaction validation

ARMYRED HOST will offer the Services on the Website, and the User may accept the offer through the means the Website provides for that purpose. Confirmation and/or validation by ARMYRED HOST is required for the agreement to be formed.

3. Responsibilities and limitations

Limitation of liability

ARMYRED HOST will not be liable for any damage to equipment, software or data (whether digital or not) owned by the User or third parties that is sent, received, transmitted or hosted in any of the data centers available to ARMYRED HOST.

Under no circumstances will ARMYRED HOST be liable for actual damages (except in cases of willful misconduct), loss of profits or any other direct or indirect loss the User may suffer.

Fortuitous events and force majeure

ARMYRED HOST will not be liable for interruptions or failures of the Services attributable to fortuitous events, force majeure or third parties.

Maximum liability

ARMYRED HOST’s liability is limited to, at most, the value of the last month’s fee for the contracted service or services, based on the last invoice actually paid by the User.

4. Intellectual property

All trademarks, product names, company names and logos that appear on the Website belong to their respective owners.

The User acknowledges that any reproduction in any form or manner, copying, modification, inclusion, distribution, commercialization, decompilation, disassembly or reverse engineering of the Services offered on the Website is prohibited and constitutes an infringement of intellectual property rights.

5. Acceptable use policy

The User agrees not to engage in any of the following conduct:

Illegal activities
unauthorized distribution of protected software, violation of export restrictions, fraud, trafficking in obscene material or drugs.
Network abuse
DDoS (denial-of-service) attacks are considered a serious violation and result in immediate termination of the service.
Tortious conduct
defamatory information, infringement of registered trademarks or other protected property.
Misuse of resources
excessive use of CPU, memory, data traffic or storage space.
Malicious software
viruses, malware, spyware, phishing, pharming, hacking or cracking.
VPN/GRE tunnels
any attempt to sell them will be limited to 0.5 Mbps symmetrical.
Rights violations
publishing content that infringes intellectual property rights.

Any use of the service covered by the list above entitles ARMYRED HOST to suspend and/or terminate the service without prior notice.

6. Personal data protection

Data collection

We collect the following personal data from our customers:

  • Full name
  • Phone number
  • Email

Use of data

The data collected is used for:

  • Registering and managing the contracted services
  • Communicating about the status of your services
  • Sending relevant information and updates

Data protection

We implement appropriate security measures to protect your data against unauthorized access, alteration, disclosure or destruction.

Right to cancellation

Customers have the right to request the cancellation of their registration and the deletion of their personal data at any time, through our website, by email or through the client area.

7. Backups

Virtual servers (VPS)

At ARMYRED HOST we do not back up your virtual servers. It is the customer’s responsibility to create and maintain their own backups. ARMYRED HOST is not responsible for the loss of content due to hardware failures or other unforeseen events.

cPanel services

ARMYRED HOST stores the data of all hosted websites for a period of 7 days. If a domain is suspended, the customer has 7 days to recover its content. Our cPanel includes modules that let you make manual backups as often as needed.

8. Service maintenance

Urgent maintenance

ARMYRED HOST reserves the right to carry out urgent maintenance in exceptional circumstances, such as:

  • General service outages
  • Critical infrastructure migrations
  • Essential security updates

This maintenance will be carried out as quickly as possible to minimize the impact, and users will be notified as soon as feasible.
